Female White-Collar Crime Divas-Mordern Day Thieves
“What a tangled web we weave, when first we practice to deceive!” These words written by Sir Walter Scott several centuries ago still hold true today.
The media was blazing today when the populate reality TV star and her husband were sentenced to prison for fraud. Both the judge and the prosecutors proclaiming that public status does not provide special treatment by the law, even more so the judge declaring she was sending out a clear message that when one breaks the law punishment will be given. [I find that interesting that these judges keep quoting that line to justify putting someone in prison.]
I am going to be honest, I do not watch reality TV, not to say that there is anything wrong with it, but I have enough going on in my life than to be watching someone elses drama. I, however, found this case interesting because a celebrity was making the CrimeDivas list. Even more so, the case itself was interesting as I reviewed several articles to get an understanding of what the couple had been charged with, which is why I decided to quote Sir Walter Scott in the opening.
Today’s CrimeDivas, Theresa Giudice, 42, [Here we go, another middle-aged woman going to prison. I said they are filling up the prison with middle and older aged women. What’s really going on?] of Newark, N.J. was sentenced to 15 months in federal prison for fraud. Ms. Giudice husband, Joe, was sentenced to 41 months.
According to records, the Giudices were originally charged with 41 counts of fraud, they pleaded guilty to one count of mail and wire fraud and three counts of bankruptcy fraud, while Joe also pleaded guilty to one count of failing to file a tax return.
The couple’s troubles begin in 2009, when the Giudices declared bankruptcy, claiming millions in debt and blaming the economy. The bankruptcy trustee representing their creditors questioned the couple’s failure to declare assets and income, including rental properties and Teresa’s “Real Housewives of New Jersey” true salary. Joe later took the Fifth Amendment when questioned about the apparently flawed bankruptcy filing, and they both abandoned their quest to get their debt absolved in 2011. They still owe millions.
Then their second trouble started when Mr. Giudice was indicted in 2010 for using his brother’s identification to get a New Jersey driver’s license because his own was suspended due to a DUI, charges that carry more than 10 years in prison. Finally in July 2013, federal prosecutors not only brought bankruptcy fraud charges against the couple, but alleged a long-running conspiracy from their pre-fame days to illegally obtain millions in mortgages, construction loans and lines of credit using falsified W-2 forms and tax returns. Joe also failed to pay income tax on nearly $1 million in earnings over five years, prosecutors alleged.
Whiles going through what is a frightening ordeal the Giudice made another bad call by not disclosing all their assets while going through their pre-sentencing investigation, which brought the raft down on them by the judge when she sentenced the two considering the fact that the judge had planned on giving Ms. Giudice home confinement to be with the couple’s four daughters, instead she sentenced Ms. Giudice to 15 months, which is lower than what the prosecutor wanted, but serve the message the judge is sending out that, ‘no one is above the law’.
With all this drama the, NBCUniversal, which owns Bravo, the channel that airs “Real Housewives,” will have the couple appear together on, “Watch What Happens Live” on Monday night for their first post-sentencing interview. [I’m sure the network knowns the ratings will be high otherwise, they wouldn’t be broadcasting it, $$$$$$$$, right!]
For all the trouble, and embarrassment this couple has gone through, the government is only seeking $414,000 in restitution and what ever fines they have attached. Wow, this couple is going to prison and have had their world turned upside down for $414,000. But, there’s more; as I quoted in the opening statement it’s the web of lies–the deception that is the core problem and the reason for the punishment.
Ms. Giudice, you will get through this! It is not the end of the world and you will be a stronger person in the end.
